As outside counsel to governments and government agencies throughout Wisconsin, we effectively defend a wide range of claims.
Areas of Focus:
  • Medical negligence defense
  • Personal injury defense
  • Defense of civil rights and First Amendment claims
  • School law
Leib & Katt excels at defending counties (including the three largest in Wisconsin), municipalities and school districts throughout the state.  We represent governmental clients in administrative proceedings, and in civil cases heard before state and federal courts.  Our government litigation team includes a former member of the Iowa Attorney General’s office, typifying our knowledge of public policy and administration.  And because our firm has one of the Midwest’s premier medical malpractice defense groups, we are unsurpassed at defending health care providers who work for governmental hospitals, long-term care facilities, correction facilities and similar services when they face allegations of inadequate or negligent medical care.
We defend governmental clients using full knowledge of the special laws and regulations that define their conduct and liability.  Our lawyers are well versed at dealing with governmental immunities under Wisconsin Statute 893.80 (involving injury claims), and have obtained dismissals based on improper notice of claims or notice of injuries (including catastrophic injury).  We also regularly litigate cases for counties and affiliated agencies under 42 USCA Section 1983, dealing with alleged abuse of civil and First Amendment rights.   Our representation of governmental clients on issues of due process and equal protection under the Wisconsin and United States Constitutions is informed and effective, and we have argued these cases at trial and on appeal (including before the U.S. Seventh Circuit).
A key strength in our government litigation practice is the insight and understanding our lawyers bring to their interaction with government employees and lawyers.   In any matter we invest substantial time early to get to know the persons involved, their concerns and responsibilities.  Our lawyers speak the language of government, have full respect for issues of confidentiality, and build the kind of confidence that supports success at trial.
For public schools and school districts, alternative schools and parochial schools, we counsel on sensitive issues involving allegations of abuse, discrimination and affirmative action violations.  Our lawyers also advise on employment law issues ranging from terminations and grievances to civil rights compliance.  That includes defending educational clients in employment disputes both in state and federal courts and before administrative agencies.
