Midstate Contracting, Inc.

Midstate Contracting, Inc., a stainless steel fabricator, had allegedly manufactured a lid for a rinse tank at a dairy. The plaintiff was a dairy employee who stood on the lid and fell into a rinse tank containing caustic solution. A very sympathetic witness, he suffered severe burns over three-quarters of his body, causing great pain and suffering and substantially reducing his vocational prospects. Bill Katt and his team used a burden of proof argument to argue that the plaintiffs were unable to positively identify Midstate as the lid's manufacturer. The jury found that Midstate was did not manufacture the lid, and therefore not liable.
