Noteworthy Cases:
Teleflex Industries
We obtained dismissal of $1.5 million lawsuit against Teleflex Industries, a manufacturer of an underground storage tank line component. The case arose out of one of the largest service station fuel leaks in Wisconsin history. The service station owners sued the companies involved in the installation and manufacture of the underground storage system. The owners sought reimbursement for remediation costs and for amounts paid on personal injury claims to surrounding homeowners. The case was pending for several years before Leib & Katt became involved. Bill Katt and team identified the damages claimed and determined that the damages the service station was claiming had been reimbursed by an insurer. Once the law was researched, Bill Katt had the case dismissed on the basis that the insurer, not the oil company, was the proper party. As a result, the insurer's claim was barred by the statute of limitations.
