Our firm has a long history and extensive experience in representing and defending individuals and corporations in cases involving exposure to toxic and other dangerous substances. Sam Leib and William Katt were two of the first attorneys in the country to be retained in the latex glove litigation. They both successfully resolved those claims for their clients.
Today, directed by Shareholders Mark Malloy and Kevin Christensen, we are currently representing manufacturers, distributors, property owners and insurance companies in litigation involving exposure to toxic and hazardous substances including asbestos, silicosis, mold and lead paint.
Shareholder Mark Malloy recently successfully tried a case to jury in a construction dispute. In the case, Malloy represented one of the largest manufacturers of custom-made wood doors in the country. The company was sued by a purchaser and general contractor for negligence, misrepresentation and deceptive advertising. Malloy successfully obtained partial summary judgment on the negligence and misrepresentation claims, then tried the deceptive advertising claim to jury, arguing that the purchaser, was a sophisticated and experienced general contractor, and that he received exactly what he believed he purchased. The jury agreed, rendering a complete defense verdict, finding that the door company did not make any deceptive statement to the purchaser, and that the purchaser suffered no damage as result of any action or inaction of the door company.
