Attorney Samuel Leib Successful in Oral Surgery Malpractice Case

Attorney Samuel Leib successfully defended an oral surgeon accused of malpractice. In this case, the oral surgeon performed a routine, non-complicated extraction of the plaintiff's molar. Local anesthetic was delivered by needle without apparent complication. At the conclusion of the procedure, the plaintiff was discharged. The following day, the plaintiff complained of continued paresthesia, which failed to resolve. The Plaintiff alleged that the informed consent was deficient and that the plaintiff's lingual nerve was damaged during the extraction of the tooth either with a drill bit or spur. Attorney Leib was able to convince the jury that the oral surgeon followed the appropriate standard of care and was not responsible for the unfortunate nerve injury.
