Shareholder Mark Malloy successfully tries case to jury in construction dispute
Attorney Mark A. Malloy represented one of the largest manufacturers of custom-made wood doors in the country. The company was sued by a purchaser and general contractor for negligence, misrepresentation and deceptive advertising. Malloy successfully obtained partial summary judgment on the negligence and misrepresentation claims, then tried the deceptive advertising claim to jury, arguing that the purchaser was a sophisticated and experienced general contractor, and that he received exactly what he believed he purchased. The jury agreed, rendering a complete defense verdict, finding that the door company did not make any deceptive statement to the purchaser, and that the purchaser suffered no damage as result of any action or inaction of the door company.
