Attorney Doug Knott Successful in Diagnosis Malpractice Case
In a two-week trial in Cedar Rapids, Iowa, attorney Doug Knott successfully defended on a physician a medical negligence claim arising out of an alleged delay in the diagnosis of an aortic dissection. The defendants examined the plaintiff, ordered appropriate testing, and promptly and appropriately referred the plaintiff to a specialist qualified to address his condition. Attorney Knott, with the assistance of attorney Sean Gaynor, was able to convince the jury that the physician followed the appropriate standard of care and was not responsible for the unfortunate paraplegia.
Attorney Samuel Leib Successfully Defends Home Health Care Agency Case
Attorney Samuel Leib was successful in defending a home health care agency accused of negligence in caring for the plaintiff. The plaintiff alleged the Agency was negligent in supervising its employees and violated industry standards of care, which resulted in decubitus ulcers and permanent injury, causing her to incur past and future medical needs. Attorney Leib was able to convince the jury that there was no causal connection to the injury incurred by the plaintiff and the care provided by the Agency.
Attorney Samuel Leib Successfully Defends Wrongful Birth Case
In an unusual trial in Waukesha County, attorney Samuel Leib successfully defended a physician in a "wrongful birth" case. Plaintiff alleged the defendant failed to provide adequate informed consent to the plaintiff and failed to exercise reasonable degree of medical care when he performed a tubal sterilization on the plaintiff. It was claimed that the defendant's breach of the standard of care caused the unanticipated pregnancy, birth of a child, pain and anguish from the pregnancy, anxiety, loss of enjoyment of life, and past and future economic losses. Attorney Leib, with the assistance of attorney Nadya Shewcyzk, was able to convince the jury to find no negligence on the part of the defendant.
Attorney Samuel Leib Prevails in Medical Malpractice Case
Attorney Samuel Leib was successful in his defense of a hospital in a medical malpractice case. Plaintiff developed a post-operative infection wherein she required daily dressing changes, which were performed by her physician, physician's assistant and several nurses. Because the infectious disease process continued, the plaintiff returned to the operating room and two pieces of retained gauze were removed, which allegedly should not have been in the wound. No one could identify when the gauze was packed or who packed the gauze in the wound. The jury concluded all the health care providers exercised the appropriate standard of care in performing the dressing changes.
Firm Administrator and Firm Accountant Hired by Leib & Katt
Leib & Katt is pleased to announce the hiring of Lori T. Brown as the firm's new Administrator and Susan Van Aartsen as the firm's new Accountant. Ms. Brown earned her BS from Oral Roberts University in 1987 and her JD from Tulsa University in 1990. After practicing insurance defense litigation for four years, she shifted her focus to human resources, becoming the Human Resource Manager and Safety Coordinator for a chain of grocery stores in Kansas City, Missouri. She moved to Milwaukee six years ago and lives in the Bayview area.
Ms. Van Aartsen graduated from UW-Milwaukee and worked as a member of the Internal Audit team at Firstar Bank (now US Bank) for six years with exposure to all areas of banking finance and accounting. Subsequently, while raising her four children, she worked as an independent contractor providing accounting and tax services. She actively volunteered numerous hours to her children's schools, assisting with accounting, technology, personnel and improvement committees. She currently lives in Brookfield with her husband Randy.
